Paterson settles developer’s lawsuit alleging city improperly charged in abandoned properties registration fees

The city’s governing body settled a lawsuit filed by local real estate developer Charles Florio alleging the municipality improperly charged him through the abandoned properties ordinance, according to city records.

The terms of the settlement were as follows, according to the resolution approved by council members: the 31 properties owned by Florio’s company and subject of the lawsuit will be charged one-time $500 registration fee and “any excessive fees up to a total of $30,000” paid to the city for each of the properties will be credited to the developer through municipal inspection and permit fees by the Community Improvement Division.

The lawsuit alleged city employees improperly charged Florio $60,500 in fees.

The city will not pay any cash in the settlement, according to officials. Florio owns hundreds of properties in the city’s 4th and 1st Wards through his company JCM Investors. The lawsuit was filed by Florio Management, according to the adopted resolution.

Council members approved the settlement without any public comments following a closed-door meeting with their attorney on Tuesday evening.
