Indicted Paterson police sergeant allegedly assaulted man in 2018, lawsuit says

David Legriere, a city resident, is alleging indicted police sergeant Michael Cheff assaulted him during an interaction nearly two years ago.

Legriere filed a lawsuit against the city on July 7. He claims he was on Governor Street on August 15, 2018, when police were investigating a crime scene. His residence “abutted the area that had been designated as a crime scene,” says the suit.

Police initially allowed him into the area.

“After having traversed the area on more than one occasion” Legriere “again began to do so,” says the lawsuit. “Cheff demanded that he leave the area.”

Legriere tried to explain to Cheff that he lived at the scene and had been allowed to walk in the area.

Cheff allegedly refused to let him continue to walk in the area. Legriere protested the decision. The lawsuit says Cheff assaulted Legriere and arrested him.

Legriere was charged with obstructing a police officer and resisting arrest by force. A municipal court judge later dismissed the charges after police failed to produce evidence that led to the charges.

Cheff allegedly violated Legriere’s constitutional rights, says the lawsuit.

Legriere is seeking an unspecified sum in damages.

A federal grand jury formally charged Cheff earlier in the year with supervising five rogue police officers who conducted unjustified search of people’s vehicles and homes to confiscate cash.
