A man from Paterson allegedly engaged in sexual contact with a child he was babysitting in Wayne on New Year’s Eve, according to the Passaic County Prosecutor’s Office.

Joseph Montgomery, 33-year-old, has been charged with two counts of second-degree endangering the welfare of a child, third-degree aggravated criminal sexual contact, and fourth-degree criminal sexual contact.

Montgomery was babysitting a 13-year-old child on December 31, 2020 into the morning hours of January 1, 2021. He allegedly provided the child with alcoholic beverage and marijuana, authorities said. He then inappropriately touched the child, authorities said.

Wayne police were notified of the incident on January 2, 2021. They responded to the residence and conducted interviews with multiple witnesses and the victim.

Montgomery faces a maximum of more than 25 years in state prison if convicted on the charges.
