Paterson paying $75,000 to woman who fell and injured herself on a sewer grate

Municipal officials agreed to pay a woman $75,000 to settle a lawsuit in which she claims to have fallen and injured herself on a sewer grate or catch basin.

Jashina Green and her husband, Brian Jackson, sued the city in 2019. They claim Paterson and its public works department were negligent in the upkeep of the sewer grate, allowing a “hazardous condition” to exist unabated, and therefore liable.

Green’s lawsuit says the hazardous condition existed at or near Crosby Place and Park Avenue on May 17, 2018. She fell on the sewer grate or catch basin and sustained “severe and permanent injuries” that caused “great pain and suffering,” according to the lawsuit.

She incurred unspecified amounts in bills for medical treatment for the injuries. Her husband also suffered an injury as a result of her fall because of “loss of usual services and consortium of his wife,” says the lawsuit.

Members of the City Council approved the settlement last Tuesday after discussing the case with the city’s attorneys in a closed-door meeting.
