North Carolina man arrested in New Jersey custody dispute case

A Cary, North Carolina, man was arrested without incident on June 7 by members of the United States Marshals Service after an investigation by police and the Passaic County Prosecutor’s Office.

Anthony Smith, 47, was charged with second-degree interference with custody. On May 28, police were dispatched to the area of East 27th Street and 21st Avenue in Paterson, New Jersey on a report of a custody dispute. A Paterson resident reported that the father of her 10-month-old daughter had not returned the child to her on May 26, as required by their court-ordered visitation agreement.

After an investigation by police and the Passaic County Prosecutor’s Office, a warrant was issued for Smith’s arrest on June 5. He was apprehended in North Carolina on June 7. The child was found in good health and reunited with her mother.

Smith is pending extradition to New Jersey. If convicted, he faces a sentence of 5 to 10 years in New Jersey State Prison for second-degree interference with custody.
