Paterson police arrest two, seize loaded handgun in Dale Avenue traffic stop

A motor vehicle stop on Dale Avenue late Saturday night led to two arrests and seizure of a loaded handgun.

Fahim Scudder, 23, and Axer Garcia, 21, were charged with weapons offenses.

Scudder was driving a silver Dodge Avenger with tinted windows through the intersection of Dale Avenue and Slater Street heading towards Railroad Avenue at about 10:20 p.m. He made a left turn allegedly without signaling, according to law enforcement records.

Police officers Jensin Burgos and Levis Qirjako activated their emergency lights and pulled over the Dodge Avenger.

Burgos approached the vehicle on the driver’s side while Qirjako approached on the passanger side. Both illuminated the interior of the vehicle using their flashlights.

Scudder produced a temporary registration and insurance, but did not have a driver’s license.

Burgos asked Scudder if there were any passengers in the rear seats. Scudder rolled down the windows.

Police officers saw a blue Aoking backpack with a gun sticking out of it. Scudder and Garcia were ordered out of the vehicle. Both were searched and placed in handcuffs.

Garcia told police the firearm belonged to him.

A .9mm Smith & Wesson handgun loaded with 16 rounds was recovered. 10 .9mm Luger ammunition were also seized.

Scudder was charged with four weapons offenses. He was also issued summonses for tinted windows, driving while suspended, driving while unlicensed, failure to use turn signal, and failure to produce a driver’s license.

Garcia was charged with three weapons offenses.

Both Scudder and Garcia were taken to police headquarters for processing and later taken to the Passaic County Jail.
