Judge blocks Alex Mendez from taking office in Paterson on July 1

Passaic County Superior Court judge Ernest Caposela ruled on Tuesday morning to block councilman-elect Alex Mendez from taking office at the City Council reorganization meeting on July 1.

“It would be a tremendous undermining of the voting system, the public trust, to let Mr. Mendez be sworn in tomorrow,” said Caposela in ruling against Mendez.

Mendez (pictured) has been charged with voter fraud and election fraud.

Longtime councilman William McKoy, who was ousted by Mendez, filed in court for an injunction to keep Mendez from taking office.

McKoy’s attorney Scott Salmon argued “irreparable” harm would be caused if Mendez is allowed to “reap” the benefit of his alleged fraud.

“If Mr. Mendez is sworn in, he will be able to vote on the budget, on personnel matters — he will be able to award public contracts and so on,” argued Salmon. “We believe it is manifestly unfair and will cause irreparable harm both to Mr. McKoy as well as to the city Paterson voters of the 3rd Ward if Mr. Mendez can take the seat when there is credible evidence that he only obtained that seat by virtue of fraud.”

Mendez’s attorney Gregg Paster opposed the injunction. He said McKoy’s campaign is arguing using “hearsay” evidence. He argued there’s a conspiracy against Mendez by political leaders like mayor Andre Sayegh.

Paster said the Mendez campaign has no idea who Yahaira “YaYa” Mendez is. She was allegedly hired by the Mendez campaign to handle bundles of ballots, according to allegations made by McKoy in court filings.

“She could be working for the McKoy campaign for all we know,” said Paster.

Paster argued blocking Mendez from taking office would be “unprecedented” and violate his constitutional rights. He said his client is innocent until proven guilty.

Caposela granted the injunction. He is expected to issue a written opinion later.

Mendez can appeal Caposela’s ruling to the appellate division, said the judge.

    NOW HE STRIPED A COUNCILMAN OF HIS SEAT WITHOUT DUE PROCESS OF LAW, THAT HE IS GUILTY JUST BY A COMPLAINT.
    THEN WHAT ABOUT THE COMPLAINTS I HAD WITH THE SEVEN OF THEM IN 2017? SMDH.

    I'v been sick in bed for three days but this makes me sicker when people keep sending it to me. Feeling a little better so I'm going to respond.

    This case helps my claim against that Judge Caposela, how they target those who are not part of the establishment, when the Feds prove he has been contacting other judges in my case, I'll show you soon, he will be removed from office as well, God is not a fool.

    Seven officials were criminally charged and Brough before him including Andre Sayegh, he use his powers to help the Democratic Party by blocking it from going to a grand jury, and most of them had no attorney.

    What Caposela is saying is Mendez is guilty, without a trial or the right to prove his defense.

    Why did he not block the seven Paterson officials from office instead of aiding the corruption when they were charged for Official Misconduct and misusing their office? Selective Prosecution.

    Time will tell, all the corruption that is in Paterson is being done by the judges the Democratic Party controls, they are assigned in that position and they rule as they are influenced, I am told.

    Evidently this came from the Governor's office who already said he want's Mendez out, and Judge Caposela is controlled by the Governor for his reappointment and to stay the assignment judge a sheriff officer informed me.

    Such corruption is disgusting in Paterson and now that Caposela is in my deposition as to if I'm going to pursue criminal charges against him, hopefully I'll prove in the trial with Paterson how he is as corrupt as they are.

    A man is 'innocent until proven guilty." So how is he allowed to block Mendez, it violates the constitution the swore and oath too.

    And when Joey Torres was simply charged, why did they no immediately removed him from office? because that case was the FBI and they know they could not do that but the people of Paterson is being fooled that this judge could over ride "due process" and the rights of the voters.

    Due Process is federal protection that you have to allow a trial to prove innocent or guilt and not a judge making up his own laws are rules to please the Democratic Party.

    So Judge Caposela dismissed all those voters to become the sole vote in the third Ward to elect a Councilman by the sketchy complaint of one woman who can't remember half of what she did or who was with her.
    Sounds like a set up to me, from the play book of corrupt Andre Sayegh.

    Adding this to my federal complaint against Paterson to prove I was right and how they control the judges to target their enemies.
